Terms and Conditions of Sale

This document (Terms and Conditions of Sale) defines the conditions applicable to sales concluded between on the one hand the persons making a purchase via the website of Lucie Monin SARL, hereinafter referred to as "the customer" and on the other hand the company Lucie Monin SARL, hereinafter referred to as "Luciemonin.com". These conditions apply exclusively to individuals who are not traders. These conditions apply to the exclusion of all other conditions, including those in force for sales in stores.

These general conditions of sale concern exclusively non-trading individuals aged at least 18 years.

The customer is understood to be any natural person who acts for purposes that do not fall within the scope of his or her commercial, industrial, artisanal or liberal activity, who is at least 18 years old and who has ordered at least once on the site.

The creation of a customer account is reserved for all natural persons aged at least 18 years.

Item prices

All the prices of the articles are indicated in euros all inclusive of tax except share in the expenses of treatment and forwarding (see paragraph Forwarding and Delivery).

The items will be charged on the basis of rates in effect at the time of registration of orders. They remain the property of Luciemonin.com until full payment of the price. This price is payable in full and in one payment.

Customs duties

Any order on the site and delivered outside of France may be subject to possible taxes and customs duties that are imposed when the package reaches its destination.

These customs duties and taxes related to the delivery of an item are the responsibility of the customer and are his responsibility. 

Luciemonin.com is not required to verify and inform its customers of customs duties and taxes applicable.

Order

The customer can place an order on the website www.luciemonin.com
The ordering process is as follows:

·       Choosing items and adding to cart

·       Validation of the contents of the basket

·       Identification on the site www.luciemonin.com if the client is not already identified

·       Choice of delivery method

·       Choice of payment method and acceptance of the T&Cs

Payment validation

The customer will receive an e-mail confirming the order and will be able to view the details of his order and its total price and correct any errors before confirming it to express his acceptance.

Luciemonin.com reserves the property of the articles until the complete payment of the order, i.e. the collection of the price of the order by www.luciemonin.com.

Luciemonin.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order or which would present any form of risk in its eyes.

Any order is acceptance of prices and description of items available for sale.

Luciemonin.com agrees to honor orders received on the website only within the limits of available stocks. In the absence of availability of one or more items ordered, Luciemonin.com will inform the customer as soon as possible, and if necessary to reimburse the customer within 30 days of payment of the amounts paid. The customer's order will then be automatically cancelled.

Payment validation

The payment is validated upon receipt of additional information requested in case of payment by credit card requiring additional checks (See paragraph Fight against credit card fraud).

Fight against credit card fraud

Luciemonin.com reserves the right to verify the personal data provided by the customer and to adopt all measures deemed necessary to verify that the person whose bank account is debited is the one who placed the order, this to avoid any fraudulent payment. This verification may take the form of a request for proof of identity and/or residence and/or bank documents (RIB or cancelled check). The lack of response from the customer to a request of this type within 2 days after the request made by Luciemonin.com will automatically result in the cancellation of the order concerned, without any possibility of subsequent claim.

Luciemonin.com will also be free to proceed to the direct cancellation of an order that would present one or more risk factors of fraudulent use of credit card.

Responsibility

Luciemonin.com is fully responsible to the customer for the proper execution of the contract concluded with the customer.

However, the responsibility of Luciemonin.com can not be held liable for breach or improper performance of the contract concluded in case of force majeure, the occurrence of a fact attributable to the customer or any inconvenience, unforeseeable and insurmountable inherent in the use of the Internet, including a break in service, external intrusion or the presence of computer viruses. The site Luciemonin.com contains hyperlinks that may refer to other websites. Luciemonin.com can not be held responsible for the content of these websites if they were to contravene the laws and regulations in force.

The photographs and illustrations accompanying the products on our website have no contractual value and therefore can not engage the responsibility of www.luciemonin.com.

Guarantee

All items offered by Luciemonin.com are subject to the legal guarantee provided by Articles 1641 and following of the Civil Code.

The customer has a period of 3 days from receipt of items to make any reservations or claims for non-conformity or apparent defect of items delivered, by e-mail contact@luciemonin.com ; or by registered mail with acknowledgement of receipt to the following address Lucie Monin SARL, 75, rue Saint Jacques 75005 Paris.

After this period and in the absence of having respected this formality, the articles will be considered in conformity and free of any apparent defect and no complaint could be validly accepted by www.luciemonin.com.

If the apparent defect or lack of conformity of the article is proven, Luciemonin.com undertakes to refund the customer as soon as possible and at its expense.

This refund will be made within a maximum of 30 days.

Luciemonin.com can not be held responsible for the misuse and / or intensive use of items that could make the customer.

Refund policy

Time limit for returning an item - Right of withdrawal

In accordance with the law in force (Article L121-20 of the Consumer Code), the customer has a period of 14 clear days to exercise his right of withdrawal from the date of receipt of the goods without having to justify reasons or pay penalties. The modalities of exercising this right of withdrawal are mentioned in the paragraph "Return and refund" below. The return costs are at the charge of www.luciemonin.com.

The customer will be fully reimbursed for the sums paid for the purchase of the product as soon as possible and at the latest within 30 days following the date on which he/she exercised his/her right of withdrawal.

Conditions of return for refund

The returned item(s) must be new, unused and in their original box perfectly intact.

Lucie Monin SARL will make the refund within 15 days following the reception of the return package at our warehouse.

The customer will have to keep the proof of deposit of the parcel which will be given to him by the carrier. In case of loss of the parcel, no refund will be made without this proof of deposit.

The customer has a period of 15 working days from the date of deposit of his return package to make any claim relating to his return.

No claim will be accepted after this period.

The customer must send his complaint by e-mail to contact@luciemonin.com

Item status

All returned items (shoes, original packaging, accessories, instructions...) must be returned perfectly intact.

Upon receipt of the package, Lucie Monin SARL will judge the perfect condition of the returned goods. No return will be accepted if the returned items have been visibly used or damaged by the customer and that this use or damage makes the items unfit for sale. If the return is refused by Lucie Monin SARL, the items will be returned to the customer at the expense of Lucie Monin SARL without the customer being able to demand any compensation or right to reimbursement, with the exception of the subsequent exercise of his warranty rights on the goods sold.

Refunds on returns

Subject to the respect of these conditions of return, Lucie Monin SARL will proceed to the refunding of the returned articles in the 30 days following the reinstatement in stock of the goods.

Shipping Policy

Shipping and Delivery

The products are shipped to the delivery address indicated by the customer during the order.

Excluding the periods of sales, any order placed on the site of Lucie Monin SARL before 10 am from Monday to Friday (except holidays) will be prepared by our team the same day, subject to validation of the payment (see paragraph Validation of the payment).

For the products Customs personalized in our Parisian workshops it is necessary to count a delay from 1 to 3 weeks. The delivery times can vary according to the periods of vacations and public holidays.

Lucie Monin SARL commits to deliver the ordered and paid articles by the customer within the planned time. If the said articles have not been delivered within 15 working days from the delivery date provided for in the order, and if this delay is not due to a case of force majeure, the customer may proceed to the resolution of the sale by sending a registered letter with acknowledgement of receipt to the following address

The sums paid by the customer will then be entirely restored to him.

Upon receipt of the order, the customer will check the conformity of the products received.

Any anomaly concerning the articles (damage, missing article compared to the order form, damaged or opened parcel, broken article, defective...) will have imperatively to be notified, the same day of the reception or at the latest 3 days following the reception, to the head office of Lucie Monin SARL by registered mail or by e-mail at the address : contact@luciemonin.com.

Any claim made after this period will be rejected and Lucie Monin SARL will be released from any responsibility.

If the above conditions are met, Lucie Monin SARL will then proceed to the refund of the defective product(s), the customer will be able to place an order again and Lucie Monin SARL will then proceed to the reshipment of the missing product (subject to the validity of the customer's request).

All items offered by Lucie Monin SARL are subject to the legal guarantee provided by articles 1641 and following of the Civil Code. (See paragraph Guarantee in our T&Cs)

Privacy Policy

Intellectual Property

All texts, comments, works, illustrations and images reproduced on Luciemonin.com are reserved under copyright and intellectual property for the world. As such and in accordance with the provisions of the code of intellectual property, only the use for private use is allowed, subject to different provisions, even more restrictive code of intellectual property. Any reproduction in whole or in part of the site Luciemonin.com is strictly prohibited without prior agreement.

Protection of personal data

Luciemonin.com collects personal data about the customer visiting the site www.luciemonin.com.

This data collection is carried out :

·       when the customer creates an account,

·       when the customer subscribes to newsletters or alerts proposed by Lucie Monin SARL,

·       when the customer places an order or a return request on the site,

·       when the customer contacts the Customer Service of Lucie Monin SARL,

·       when the customer participates in a contest,

·       when the customer browses the site and consults articles,

·       when the customer writes a comment or a review on an item,

·       when the customer shares a review with a friend by sending an e-mail from an article record,

·       When the customer shares a review via Facebook, Google+, Twitter, or Pinterest from an item record.

The data collected is intended for use by www.luciemonin.com. They are necessary for the processing and management of customer orders and commercial relations between Luciemonin.com and the customer. They also allow Luciemonin.com to provide the customer with personalized services and improve the relevance of information offered to him.

Luciemonin.com is responsible for their treatment. They may be transmitted to companies and subcontractors that Luciemonin.com uses in the execution of orders and services offered.

In accordance with the law of January 6, 1978, the user has a right to access, rectify, modify and delete data concerning him. The user can expressly oppose the disclosure of his details. For that, it is enough for him to announce it by writing to Lucie Monin SARL, 75, rue Saint Jacques 75005 Paris.

Data storage

The data of customers and prospects are kept for a period of 5 years from the end of the relationship. The period starts either from the last order, or the last connection to the customer account, or the sending of an email to the customer service, or a click on a hyperlink of an email sent by Lucie Monin SARL, or the putting of products in the basket without concretizing the purchase, or finally a positive answer to an email asking if the customer wishes to continue to receive commercial prospecting at the end of the period of five years.

At the end of this period, the data of the customer or prospect will be anonymized.
